Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to opposite party no.3 to accord permission in view of the recommendation as per letter dated 02.05.2022 under Annexure6 and the work programme furnished by the petitioner in extending period of contract to complete the work in extending period of contract up to May 2023 for the work Construction of HL Bridge over Local Nallah at 2nd Km. on Bhejingwada to Gumuka Road in the district of Malkanagiri under BSY vide Divisional Agreement No.64P1 of 2018-19 of Executive Engineer (R.W.), Division-II, Malkanagiri to secure ends of justice.

In course of hearing, learned counsel for the petitioner states that the petitioner has already furnished the work programme along with an affidavit under Annexure-8 stating that he will complete the aforesaid work before 31st March,
2023. Therefore, direction be issued to opposite party no.3Chief Engineer, (Building and Bridges) Rural Works (O), Bhubaneswar to consider Annexure-8 within a stipulated time, to which learned Additional Government Advocate has no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.3 to consider Annexure-8 filed by the petitioner and pass appropriate order in accordance with law as expeditiously as possible, preferably within two weeks, from the date of production of certified copy this order.
