This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in Special Case (NDPS) No.49 of 2022, pending on the file of learned Sessions Judge-cumSpecial Judge, Boudh arising out of Boudh P.S. Case No.225 of 2021, for alleged commission of offence under Section 20(b)(ii)(C) of the NDPS Act.

It is submitted that the Petitioner is in custody since 7.9.2022. Since learned Court in seisin was not inclined to release the Petitioner on interim bail, assailing the same the present bail application has been filed.

Learned counsel for the Petitioner seeks permission to withdraw this bail application with a liberty to move the learned Court in seisin.

6.

If such an application is filed, the same shall be considered by the learned Court in seisin over the matter on its own merit

without being influenced by the earlier order of rejection or the order passed by this Court.

The BLAPL is accordingly disposed of.
