1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. Laxman Pradhan, learned counsel for the Petitioner.

3. This transfer petition has been filed seeking transfer of C.P. No. 27 of 2022 from the Court of learned Judge, Family Court, Nawarangpur to learned Judge, Family Court, Berhampur.

3. Learned counsel for the Petitioner submitted that the proceeding in C.P. No. 27 of 2022 has been filed by the wife seeking a decree of divorce. It is also contended that the present Petitioner/Opp. Party in the aforesaid C.P. has no objection for grant of a decree of divorce in favour of the Petitioner-wife and he will not file any objection to such petition, if the case will be targeted and subject to determination of the permanent alimony as claimed by the wifeOpp. Party.

4. Considering the submission made by Mr. Pradhan, learned counsel for the Petitioner, this Court while disposing the transfer petition, permits the Petitioner to file appropriate application by giving his consent to the prayer made in C.P. No. 27 of 2022 for

// 2 // grant of decree of divorce subject to payment of permanent alimony as will be fixed by the learned Family Judge.

5. It is observed that if any such application is moved by the Petitioner, then learned Family Judge will dispose of the proceeding in accordance with law within a period of two (2) months from the date of filing of such petition.

6. The transfer petition is disposed of.
