This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Learned counsel for the petitioners submitted that 1.C.C. Case No.02 of 2017 is now subjudiced in the Court of learned J.M.F.C., Bangomunda but in the cause title, it has been inadvertently mentioned as 'J.M.F.C., Kantabanji'.
Heard learned counsel for the petitioners and learned counsel for the State.
// 2 // This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with 1.C.C. Case No.02 of 2017 pending in the Court of learned J.M.F.C., Bangomunda for alleged commission of offences under sections 447/325/307/506/34 of the Indian Penal Code.
Perused the complaint petition.
The earlier anticipatory bail application of the petitioners in ABLAPL No.1572 of 2022 was disposed of as per order dated 23.02.2022 on the ground that it is a complaint case and summons have been issued to the petitioners for their appearance and there is no apprehension of arrest of the petitioners.
Learned counsel for the petitioners has produced the certified copy of the order sheet from which it reveals that cognizance of offence was taken for offence under sections 447/325/307/506/34 of the Indian Penal Code and summons were issued and thereafter though the petitioners entered appearance through their Advocate and vakalatnama was filed along with the time petition on 26.10.2021, the case was adjourned to 15.11.2021 and again on that day, another time petition was filed but thereafter neither the accused persons appeared before the Court nor any step was taken on their behalf. Again on 25.03.2022, one time petition was filed and it was allowed and thereafter, the accused persons did not
// 3 // take any step and ultimately on 16.09.2022, N.B.W.(A) has been issued against the petitioners. The certified copy of the order sheet is taken on record.
In view of the available materials on record and the conduct of the petitioners, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender in the Court below and move for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law. The case records shall be made available to the Court concerned for adjudication of the bail application.
The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
