Heard learned counsel for the Parties.

Dispute involves auction of a village tank. For there is already an elected Panchayat operating in the area, in disposal of the Writ Petition, this Court directs the Barundei Gram Panchayat to find if the tank involved is already in auction or not and in the event the tank is yet to be auctioned or the auction period is already expired, to take immediate steps for auctioning the tank involved. The Petitioner has the liberty to participate in the auction. (Biswanath Rath) Judge M.K.Rout
