This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.895 of 2022, pending in the file of learned S.D.J.M., Jharsuguda, arising out of Belpahar P.S. Case No.84 of 2022, offence under Sections 376/511/294/506/323 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda by order dated 26.08.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner is in custody since 13.04.2022 and charge sheet has been filed on 30.04.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account the heinous nature of the allegations, learned court in seisin over the matter is requested to enquire periodically regarding the welfare of the victim. 7.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station twice every week till conclusion of trial. First date and time of such appearance shall be specified by the learned Court in seisin over the matter. Certification of such appearance shall be submitted to the Court in seisin over the matter and violation thereof shall entail the cancelation.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
