The Petitioner in this CMP seeks to assail the order dated 21st May, 2022 (Annexure-4) passed by learned Senior Civil Judge, Jagatsinghpur in C.S. No. 05 of 2022, whereby an application under Order VII Rule 11 C.P.C. has been rejected. 3.

Since the order impugned herein is reviseable under proviso to Section 115 C.P.C., learned counsel for the Petitioner prays for withdrawal of CMP to avail the statutory remedy. 4.

In view of the above, this CMP is disposed of as withdrawn.

Certified copy of Annexure-4 shall be returned to the learned counsel for the Petitioner on substitution of attested photocopy thereof.

Urgent certified copy of this order be granted on proper application.
