Heard learned counsel for the parties.

The present writ petition has been filed with the following prayer.

"The provisional gradation list published in the year 2008 under Annexure-6 be quashed and the applicant may be given antedated promotion to the Junior SES cadre with effect from 1.2.1991 instead of 17.6.2006 as per the Orissa Subordinate Education Service Rules, 1972 like that of other similarly situated persons, namely, Sri Rabindra Kumar Panda and Sri Debendranath Das in O.A. No.1673(C ) of 1993 with all consequential and financial benefits within a time to be stipulated by this Hon'ble Tribunal or in the alternative, any other order/orders or direction/directions may be issued so as to give complete relief to the applicant."

Mr. P.K. Mohapatra, learned counsel for the petitioner submitted that the petitioner in the provisional gradation list published under Annexure-7 since was not properly placed, the present writ petition was filed with the aforesaid prayer.

Mr. N.N. Satapathy, learned Standing Counsel on the other hand submitted that as against the said provisional gradation list, the petitioner has already filed his objection under Annexure-8. 6.

In that view of the matter, this Court while disposing the writ petition directs opp. party No.1 to consider the objection so filed by the petitioner under Annexure-8 and take a decision on the same within a period of one month from the date of receipt of this order, if the same has not yet been considered and disposed of.
