This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is accused in connection with G.R. Case No.260 of 2022, pending in the file of learned Nyayadhikari, Grama Nyayalaya-cum-JMFC, Sanakhemundi, Ganjam, arising out of Pattapur P.S. Case No.267 of 2022, for commission of offences under Sections 419/420/467/468/471/120-B/506/34 of IPC read with Section 81/82 of the Registration Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Berhampur, Ganjam, by order dated 24.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 17.08.2022 and keeping in view

the nature of allegations and as investigation has progressed substantially, his further continuance in custody is unwarranted. 6.

On perusal of the order of rejection, it is seen that prima facie the allegations are based on documents and keeping in view the submission that the petitioner is the first offender and the stage of investigation, this Court directs the petitioner to be released on bail. Learned Court in seisin over the matter shall fix the terms so as to ensure the presence of the petitioner on each date of trial. 7.

Additionally it is directed that the petitioner shall appear before the Investigating Officer once every week till conclusion of final form.

Accordingly, the BLAPL stands disposed of.
