Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The I.A. has been filed for modification of order dated 03.08.2022.

It is submitted that the bail application was filed by five petitioners but the order dated 03.08.2022 has only been passed in respect of only petitioner.

In view of the fact that the error appears at multiple places, instead of effecting any correction, it would be convenient to recall the entire order and to pass an order afresh after incorporating the necessary changes.

The order dated 03.08.2022 is hereby recalled and fresh order is passed today.

I.A. is disposed of.

It is submitted that certified copy of the earlier order has been submitted in the court below.

The petitioners are in custody since 22.08.2021 in connection with Baipariguda P.S. Case No. 65 of 2014 corresponding to G.R. Case No. 387 (B) of 2014 pending in the Court of learned S.D.J.M., Jeypore for the alleged commission of offence under Sections 147/148/149/302 of IPC.

It is alleged that the petitioners belong to a group of around fourteen persons, who jointly assaulted the deceased by means of axe and another deadly weapons causing his death. There are no eyewitnesses to the occurrences, save and except some persons, who have seen the assailants leaving the spot after the occurrence. Some of the co-accused persons have already been released on bail as per order passed by this Court in BLAPL No.3530 of 2019. The petitioners appear to be standing on the same footing. 4.
In such view of the matter as also taking into account, the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
