1. This matter is taken up through hybrid arrangement.
2. Heard.
3. The Petitioner who is serving as a Demonstrator in Zoology in terms of Rule-8(2)(b) of the Odisha Education (Recruitment and Conditions of Service of Teachers and Members of the Staff of Aided Educational Institutions) Rules, 1974 against a sanctioned and approved post consequent upon transfer of a regular Lecturer of Botany of Baba Bhairabananda Autonomous Mahavidyalaya, Chandikhole, in the district of Jajpur to another College. He seeks a direction from this Court to the Opposite
// 2 // Party No.1/ Principal Secretary, Higher Education Department, Government of Odisha, Bhubaneswar for according approval of his promotion to the post of Lecturer in Botany. But the recommendation of the Principal-cum-Secretary of the College has not been approved. Therefore, the Petitioner is constrained to approach this Court for seeking relief. But the said recommendation under Annexure-7 is pending before the Opposite Party No.2/ Director, Higher Education, Odisha, Bhubaneswar.

Since the aforesaid recommendation is pending since 2016, the Opposite Party No.2/ Director, Higher Education, Odisha, Bhubaneswar is directed to consider and dispose of the same within a period of one month from the date of submission of a copy of this order. If the same is not available in the office of the Opposite Party No.2/ Director, Higher Education, Odisha, Bhubaneswar, the Petitioner is at liberty to approach the authority with a fresh representation and the same shall be disposed of by the Opposite Party No.2/ Director, Higher Education, Odisha, Bhubaneswar within a period of one month from the date of presentation of fresh representation along

5. Accordingly, this Writ Petition is disposed of.
6. Urgent certified copy of this order be granted on proper application.
