This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.1591 of 2022 pending on the file of learned S.D.J.M., Jajpur, arising out of Jajpur P.S. Case No.249 of 2022, for commission of offence under Sections 341/324/307 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Jajpur by order dated 21.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner is in custody since 13.07.2022 and as charge sheet has been filed on 30.9.2022, his further incarceration is not necessary.

Learned counsel for the State opposes the prayer, inter alia, on the ground that the incised wound is on the vital part of the injured.

It is submitted by the learned counsel for the Petitioner, on instruction, that the injured has recovered and leading a normal life. 8.

Considering the same, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
