Since this matter has been transferred from the Odisha Administrative Tribunal, Berhampur Bench, this Court vide order dated 8th September, 2022 directed for issuance of notice to the petitioner. Accordingly, the Registry has taken steps to issue notice to the petitioner. This matter has been listed on earlier occasion, but no one appeared on behalf of the petitioner. Today also, no one appeared for the petitioner when the matter is called.

Mr. M.K. Khuntia, learned Addl. Government Advocate has taken this Court to the prayer made in the petition which is extracted hereunder:- "7.

Relief(s) sought for:- Under the facts and circumstances of the case the applicant prays that the Hon'ble Tribunal may please to grant the following reliefs: (1) To direct the Respondent No.1 to finalize the departmental proceedings initiated against the applicant as indicated under Annexure-I & II within a stipulated period, and grant all consequential service benefits including the promotion of the applicant.

(2) To direct the Respondent No.2 & 3 for early transmission of L.P.C. and Service Book of the applicant to respondent No.1 for early disposal of the departmental

// 2 // proceeding and for other consequence service benefits including promotion and revision of pay as per the O.S.R.P. rules from time to time.

(3) To grant any other reliefs as deems fit in the interest of justice."

Mr. Khuntia, learned A.G.A. submitted that a direction can be issued to the opposite parties to do the needful in the event the same has not yet been done.

In view of the aforesaid submission, interest of justice would be best served, if the Opposite party No.1 is directed to finalize the departmental proceeding(s), if any, pending against the petitioner at the earliest and with regard to 2nd prayer for early transmission of L.P.C. and Service Book of the petitioner to the Opposite Party No.1, the needful be done by the appropriate Authority forthwith, if not already communicated for facilitating early completion of disciplinary proceeding. 4.

With the aforesaid observation and direction, this writ petition stands disposed of.

Mr. Khuntia, the learned A.G.A. is instructed to transmit the copy of this order to the appropriate authority/opposite parties.
