This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with S.T. Case No.13/75 of 2021, pending before the Court of learned 2nd Additional Sessions Judge, Puri, arising out of Penthakata Marine P.S. Case No.84 of 2021, for offences under Sections 363/366/376(2)(I) of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Puri, by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim who is mentally challenged.

Since the trial has already commenced, this Court is not inclined to entertain the bail application at this stage.

Learned Court in seisin over the matter is called upon to conclude the trial within a period of three months from the date of receipt/production of the copy of this order. In the event trial is not concluded within the time specified, it shall be open to the petitioner to renew his prayer for bail before the learned Court in seisin over the matter afresh which shall be considered on its own merits.

Registry is requested to communicate this order. 9.

Accordingly, the BLAPL stands disposed of.
