This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with S.T. No.191 of 2022, pending in the Court of learned 2nd Additional Sessions Judge, Baripada, arising out of Betnoty P.S. Case No.151 of 2022, for offences under Sections 376/341/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Baripada, by order dated 20.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim in which the overt act committed by the petitioner has been clearly spelt out, such statement is also fortified by the medical examination report of the victim.

Considering the role claimed by the petitioner, this Court is not inclined to entertain the bail application at this stage.

Accordingly, the BLAPL stands disposed of.
