Mr. Bhokta, learned advocate appears on behalf of petitioner and submits, prayer in the writ petition is for restraining the bank (opposite party no.3) from auctioning the mortgaged property of petitioner, pending disposal of vigilance enquiry directed by higher authority on communication dated 13th September, 2021 addressed to opposite party no.3.

He submits, there was issuance of notice. Opposite party no.3 has filed counter, wherefrom it appears the mortgaged property has already been sold. It was obviously done in hot haste. The discrepancies pointed out by aforesaid communication dated 13th September, 2021 are glaring.

Mr. Sahu, learned advocate appears on behalf of opposite party no.2 (lead bank) while Mr. Mishra, learned advocate appears on behalf of opposite party nos.3 to 5. 4.

By reason of action already taken by opposite party no.3, whether rightly or wrongly, the matter has travelled beyond scope of the writ petition. In the circumstances, petitioner may seek such remedy as may be advised. 5.

The writ petition is disposed of.
