This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.1596 of 2022, pending in the Court of learned S.D.J.M., Jajpur, arising out of Bari P.S. No.225 of 2022, for alleged commission of offences under Sections 341/294/307/506/324/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jajpur, by order dated 28.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 12.07.2022 and grievous injury is attributed to his sons Rajesh Beuria and Srikant Beuria and hence taking into account his age, the petitioner seeks release on bail.

Learned counsel for the State opposes the prayer for bail inter alia on the ground of ongoing investigation and criminal antecedents of the petitioner though, it is fairly stated that they are not similar nature.

Considering the age of the petitioner and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Keeping in view the criminal antecedent of the petitioner, it is directed that the petitioner shall appear before the Investigating Officer once every week till submission of the final form. 9.

Accordingly, the BLAPL stands disposed of.
