Since the informant has already appeared through learned counsel Mr. M.M. Ansari and his name is in the cause list and he is participating, no further order needs to be passed. 5.

Accordingly, the I.A. stands disposed of.

Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 3.

The petitioner is accused in G.R. Case No.1438 of 2022 arising out of Burla P.S. Case No.219 of 2022, pending in the file of learned S.D.J.M., Sambalpur, for alleged commission of offences under Sections 493/417/313/328/294/506 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Sambalpur, by order dated 22.09.2022 in the aforementioned case, the present BLAPL has been filed.

Since the consideration by the learned Court in seisin over the matter was during the course of investigation, this Court is not inclined to consider this bail application at this stage. 6.

The petitioner is at liberty to move the learned Court below after filing of charge sheet. The same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
