This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with G.R. Case No.02 of 2017, pending in the file of learned 2nd Additional Sessions Judge -cum- Special Judge (POCSO) Act, Berhampur, arising out of Bada Bazar P.S. Case No.151 of 2016, for commission of offences under Sections 363/366/376(2)(n)/376(3) of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge (POCSO) Act, Berhampur, by order dated 16.07.2022 in the aforementioned case, the present BLAPL has been filed.

Notice is stated to have been served on 02.11.2022. There is no appearance on behalf informant/victim when the matter is called.

It is submitted by the learned counsel that charge-sheet has been submitted in the case at hand showing the petitioner as an absconder and he is in custody since 24.05.2022. 7.
Perused the 164Cr.P.C. statement of the victim. 8.
Considering the tenor thereof, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
