This matter is taken up by video conferencing mode. 2.

Even though an objection is raised by the learned Counsel appearing for the contemnor(s) on the maintainability of the contempt proceeding involving the contemnor(s) herein, this Court observes, the direction issued in the final order passed in O.A. No.1285(C) of 2016 is not meant to be ignored or not complied with. Keeping in view the pendency of contempt petition long since and to avoid any further loss of time, this Court in disposal of the contempt petition directs, in the event the final order passed in the aforesaid O.A. is not complied with as of now, the present incumbent(s) shall work-out the same within a period of one & half months from the date of communication of an authenticated copy of this order by the Petitioner(s), provided the order of the Tribunal is not pending in higher forum with an order of stay of such order.

The compliance report be filed before the Registry of this Court within a period of one week thereafter. Failure of compliance of this order shall be construed to be deliberate violation of this Court's order and there will be initiation of a suo motu contempt proceeding against the contemnor(s).

As restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide memo Nos.514 & 515 dated 7th January, 2022.
