This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with G.R. Case No.631 of 2022, pending in the Court of learned S.D.J.M., Patnagarh, arising out of Khaparakhol P.S. Case No.128 of 2022, for commission of offences under Section 272/273 of IPC read with Section 52(a) Odisha Excise Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Patnagarh, by order dated 28.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner is in custody since 10.09.2022, keeping in view the nature of allegations and the punishment prescribed, this Court directs the petitioner to be
released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While releasing the petitioner on bail, the learned court in seisin over the matter shall verify criminal antecedent of the petitioner. If it comes to the fore that the petitioner has any criminal antecedent, this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
