This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No.43 of 2022, pending in the Court of learned Additional Sessions Judge-cum-Special Judge POCSO, Balangir, arising out of Saintala P.S. No.165 of 2022 dated 07.06.2022, for alleged commission of offences under Sections 363/376(2)(n)/294/506/34 of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Court under POCSO Act, Balangir, by order dated 22.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim.

Considering the tenor thereof, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
