This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks to assail the final assessment order dated 7th September, 2022 passed by the Assessing Officer-cum-S.D.O., TPNODL, Betnoti-Opposite Party-2.

Mr. Dash, learned counsel for TPNODL-Opposite Party No.2 submits that the Petitioner has not filed any appeal against the order impugned herein.

Since final assessment order has been passed, the Petitioner has a remedy under Section 127 of the Electricity Act, 2003. Hence, I am not inclined to entertain the writ petition.

Accordingly, the writ petition is disposed of with an observation that in the event the Petitioner files an appeal within a period of two weeks hence observing all formalities,

// 2 // the same shall be entertained on merit giving opportunity of hearing to the parties concerned.

Urgent certified copy of this order be granted on proper application.
