This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with S.T. Case No.24 of 2020, pending before the learned Sessions Judge, Deogarh, arising out of Deogarh P.S. Case No.87 of 2020, for alleged commission of offences under Sections 302/452/323/506/294 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Deogarh, by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the witnesses Madhu and Mandoi who are the daughters of the deceased and eye

witnesses and there has been recovery of the weapon of offence at the instance of the present petitioner under Section 27 of the Evidence Act.

Considering the number of injuries the deceased suffered, this Court is not inclined to entertain the bail application of the petitioner at this stage.

7.

It shall be open to the petitioner to renew his prayer before the learned Court below after examination of the two eye witnesses referred to as above.

Accordingly, the BLAPL stands disposed of.
