Petitioner in this CMP seeks to assail the order dated 21st September, 2022 (Annexure-6) passed by learned Civil Judge (Junior Division), Chandbali in CS No.154 of 2013, whereby an application to stay the proceeding of the Suit has been stayed.

Mr. Mohanty, learned counsel for the Petitioner at the threshold submits that there are some inadvertent errors in the CMP while drafting the petition. He, therefore, prays for withdrawal of the CMP seeking liberty to file a fresh one with better particulars.

Granting such liberty, the CMP is disposed of as withdrawn. Certified copy of Annexure-6 shall be returned to learned counsel for the Petitioner on being substituted with attested photocopy thereof.
