This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail. On perusal of the F.I.R. it appears that the allegations have been made under Sections 287/304-A/34, I.P.C.

Learned counsel for the Petitioner submits that the Petitioner is working as Section Manager at Mathasahi Section, Kuakhia under TPNODL in the district of Jajpur. Learned counsel for the Petitioner further submits that police is summoning the Petitioner in connection with the present case. Therefore the Petitioner apprehends arrest. 5.
However, considering the fact that the alleged offences are bailable in nature, this Court is of the view that there is no
// 2 // apprehension of arrest of the Petitioner, and therefore the ABLAPL is not maintainable.

Accordingly, the ABLAPL is disposed of.
