Heard Mr. B.K. Mohanty, learned counsel appearing for the petitioner.

The petitioners have filed this writ petition seeking direction to the opposite parties to implement Rehabilitation and Resettlement Policy, 2013 taking into consideration the terms and conditions of Grama Sabha and Palli Sabha by providing land for shelter of the petitioners, who are the land oustees and further to issue direction to the opposite parties to provide houses and monetary benefits in lieu of acquired lands and remove the OB dump within a stipulated period.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner-Khapurikachhar Gaon Gram Sabha Committee has made a representation to Opposite Party No.2-Collector, Sundargarh vide Annexure-4

series and the same may be directed to be considered within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by learned counsel for the parties, this Court, disposes of the writ petition directing opposite party No.2Collector, Sundargarh to consider the representation filed by the petitioner-Khapurikachhar Gaon Gram Sabha Committee vide Annexure-4 series, and pass appropriate order after giving opportunity of hearing to the petitioner in accordance with law within a period of three months from the date of production/communication of certified copy this order. 6.
