Heard Mr. J.R. Kar, learned Counsel appearing on behalf of Mr. K.N. Das, learned Counsel for the Petitioner and Mr. A.K. Mishra, learned Additional Government Advocate for the State. 3.

The Petitioner has filed this writ petition seeking direction to the opposite parties to convene a DPC for consideration of the case of the petitioner for promotion retrospectively to the rank of DSP from the date his junior Sri Anirudha Routray and Sri Bishnu Prasad Pati got promotion to the said posts on 01.12.2017. 4.

Mr. J.R. Kar, learned Counsel for the Petitioner, however seeks time to file rejoinder affidavit to the counter affidavit filed by opposite parties.

Mr. A.K. Mishra, learned Additional Government Advocate for the State contended that since the petitioner was involved in a vigilance case, therefore, he has not been granted promotion and as such Balasore Vigilance P.S. Case No. 24 dated 15.05.2017 under

Section 7 of PC Act, 1988 is pending before the Special Judge Vigilance.

In view of the above, this Court disposes of the writ petition with an observation that after disposal of the Vigilance case, the petitioner may approach the appropriate forum ventilating his grievance as has been agitated in the present writ petition. Arun (DR. B.R. SARANGI) JUDGE
