This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R Case No.352 of 2022 pending in the file of learned J.M.F.C., Polasara, arising out of Polasara P.S. Case No.359 of 2022, for commission of the alleged offence under Sections 420/467/468/471 IPC and is in custody since 15.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. District & Sessions Judge, Kodala by order dated 28.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the Petitioner that the allegation is of submitting fake B.Ed. certificate to get employment as a Junior Teacher. It is ascertained that the allegations are more or less documentary in nature and since investigation has substantially progressed, further continuance of the Petitioner in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail. 8.

Considering the nature of allegation and the period of custody, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 9.

Accordingly, the BLAPL stands disposed of.
