Heard learned counsel for the petitioner and learned counsel for the State.

Since the accusation is under the NDPS Act and as the petitioner has criminal antecedent of similar nature and in view of rigors of Section 37 of the said Act, this Court is not inclined to entertain this I.A.

Accordingly, this I.A. stands rejected.

It shall be open to the petitioner to move the Court below afresh, which shall be considered on its own merits. (V. NARASINGH) Judge Ayesha
