The grievance of the Petitioner in this CMP is with regard to inaction of learned Additional District Judge, Balasore in disposing of the application for analogous hearing of RFA No.540 of 2006 pending before it along with RFA Nos.33 and 34 of 2016 pending in the court of learned District Judge, Balasore.

In course of hearing, learned counsel for the Petitioner prays for withdrawal of CMP to move appropriate application before learned District Judge, Balasore.

In view of the above, this Court without expressing any opinion on the merits of the submission made by learned counsel for the Petitioner disposes of this CMP as withdrawn. Urgent certified copy of this order be granted on proper application.
