This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R Case No.721 of 2022 pending in the file of learned S.D.J.M., Dhenkanal, arising out of Dhenkanal Sadar P.S Case No.253 of 2022, for commission of offence under Sections 306/34 IPC.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Dhenkanal by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the present Petitioner is a lady and the nature of offence vis-à-vis her complicity in the matter and keeping in view the legislative intent in terms of the first proviso to Section 437(1) Cr.P.C, this Court directs the Petitioner to be
released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
