This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special G.R. Case No.33 of 2022, pending in the file of learned Additional Sessions Judge-cumSpecial Judge, Bhanjanagar, arising out of Buguda P.S. Case No.443 of 2022, offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Bhanjanagar, by order dated 22.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner seeks permission to withdraw this bail application with liberty to move the learned Court in seisin afresh, after submission of charge-sheet.

Giving such liberty to the petitioner, the BLAPL stands disposed of as withdrawn.
