This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.953 of 2018, pending before the learned J.M.F.C., Soro, arising out of Soro P.S. Case No.469 of 2018, for alleged commission of offences under Section 498-A/304-B/34 of IPC read with Section 4 of the D.P. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Balasore, by order dated 20.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that since charge-sheet has already been filed under Sections 498-

A/304-B/34 of IPC, further continuance of the petitioner in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that there are clear materials on record for implication of the petitioner inter alia under Section 304-B of IPC read with allied Sections.

It is borne out from the charge-sheet as submitted by the learned counsel for the State that the deceased died due to suicidal hanging in her parental house.

Taking into account the filing of charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
