Heard Mr. J. Biswal, learned counsel appearing for the petitioners.

The petitioners have filed this writ petition seeking to quash the tender call notice no.4469 dated 20.09.2022 under Annexure4. 4.

Mr. J. Biswal, learned counsel appearing for the petitioners contended that the petitioners have made innocuous prayer for disposal of their representation dated 25.09.2022 under Annexure5. 5.

On perusal of the records, it appears that the grievance of the petitioners is under consideration in RFA No.251 of 2009. Therefore, the petitioners have tried to mislead the Court by making innocuous prayer in this writ petition to dispose of their representation.

In course of hearing, learned counsel for the petitioners contended that the petitioners may be permitted to withdraw the

writ petition with liberty to pursue their remedy in RFA No.251 of 2009.

With that liberty, the writ petition stands dismissed as withdrawn.
