This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are an accused in connection with C.T. Case No.2349 of 2022, pending in the Court of learned S.D.J.M., Jharsuguda, arising out of Badmal P.S. Case No.190 of 2022, for alleged commission of offences under Sections 341/323/324/307/506/34 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda, by order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioners that the petitioners are in custody since 10.09.2022 and since final form has been submitted on 19.10.2022, further continuance of the

petitioners in custody is not warranted more so as the injury suffered by the injured-Ranjan Bhoi has been categorized as simple. 6.

The injury report of the said Ranjan Bhoi is taken on record.

Learned counsel for the State opposes the prayer for bail. 8.

Taking into account the nature of injury suffered by the victim and that the petitioners are the first offender as stated, this Court directs the petitioners to be released on bail on such terms to be fixed by the Court in seisin over the matter. 9.

Accordingly, the BLAPL stands disposed of.
