This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioners and learned counsel for the State.

This is an application under Section 389(2) read with Section 439 of Cr.P.C for bail pending disposal of the Criminal Appeal No.1 of 2022 before the learned Addl. Sessions Judge, Rairakho.

Learned counsel for the Petitioners submits that during trial, the Petitioners (convicts) were throughout on bail and have not misused the trust reposed in them.

Considering the same and taking into account that they have been sentenced to R.I for 6 years for the offence under Section 307/34 IPC, this Court directs the Petitioners to be released on bail. Terms of release to be fixed by the learned trial court. 6.

Accordingly, the CRLMA stands disposed of.
