1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences under Section 302/304(B)/498(A)/34 of IPC & Section 4 of D.P Act.

3. Learned counsel for the Petitioner submits that no material is appearing against the present Petitioner hence he may be considered for pre-arrest bail. Learned counsel appearing on behalf of the Informant honestly subscribe to it.

4. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the circumstances appearing, the seriousness and gravity of the offences, this Court is not inclined to grant the anticipatory bail,

// 2 // however, it is directed that in the event the Petitioner surrender and move for bail in connection with G.R Case No.2326 of 2022 arising out of Gopalpur P.S. Case No.194 of 2022 pending in the court of learned S.D.J.M., Berhampur within a period of three weeks' hence and moves for bail, he shall be released on such terms and conditions as would be deemed just proper by the said court with further conditions that he shall appear in person before the court below on each date of posting of the case unless specifically exempted by the court concerned.

5. The ABLAPL is disposed of accordingly.
