Heard Dr. J.K. Lenka, learned counsel for the petitioner.

Dr. J.K. Lenka, learned counsel for the petitioner contended that similar question had come up for consideration before the Tribunal in Aparna Sinha v. State of Odisha (O.A. No.1090 of 2016, disposed of on 24.05.2019). It is further contended that against the said order, the State preferred W.P.(C) No.10616 of 2020, which was dismissed vide order dated 07.09.2020 and challenging the said order, the State preferred Special Leave to Appeal (C) No.195-196/2021, which was also dismissed vide order dated 20.01.2021.

In that view of the matter, the petitioner is entitled to get relief in terms of the order dated 24.05.2019 passed by the Tribunal in Aparna Sinha (supra), which has been

confirmed by this Court as well as the apex Court. 5.

Accordingly, the writ petition stands disposed. 6.

Issue urgent certified copy as per rules.
