In the aforementioned W.P.(C) No.31477 of 2021, the instant I.A. No.13906 of 2022 has been moved seeking modification of the final order dated 15.09.2022 to the extent for granting the liberty to the petitioner to pursue his remedy before the DRT in accordance with law.

Mr. Niamati, learned counsel for the Bank states that he has no objection for such modification as it was on his objection of

// 2 // alternative remedy, the Writ Petition was got dismissed as withdrawn.

In view of the above, the I.A. No.13906 of 2022 is allowed and in the operative portion of the order dated 15.09.2022 in para 4 & 5 are ordered to be substituted as under:- "4. At this stage, learned counsel for the petitioner prays for permission for withdrawal of the writ petition to pursue his available remedies before the DRT in accordance with law.

5. In view of the above, the Writ Petition is dismissed as withdrawn with the aforesaid liberty" .

4. Necessary corrections be made.
