The petitioner being promoted to the Senior Clerk from Junior Clerk in the year 2009 was entangled in a Criminal case instituted against him in the year 2008 along with other staff members at Collectorate, Kandhamal. Since his case was not considered for promotion to the post of Head Clerk in the D.P.C. in view of pendency of criminal case, his juniors were given the scope to get promotion. Vide order dated 25th May, 2018, the learned Odisha Administrative Tribunal while issuing notice, observed that pendency of the present matter would not be a bar for the Opposite Parties to consider the grievance of the Applicant-petitioner.

When the matter is taken up today for hearing, Ms. Rasmita Das, learned proxy counsel on behalf of Mr. Laxmikanta Mohanty, Advocate, submitted that she has no instruction in this matter.
