This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No.01 of 2022 pending on the file of learned Additional Sessions Judge, Bonai, arising out of Lahunipada P.S. Case No.22 of 2022, for alleged commission of offences under Sections 20(b)(ii)(C) of the NDPS Act read with Section 25 of the Arms Act. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge Bonai by order dated 16.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner permitted to withdraw the bail application with liberty to move the learned Court in seisin over the matter at a later stage. If such application is filed, it is needless to state that learned Court in seisin over the matter shall
consider the same on its own merits without being influenced by the earlier rejection or the order passed by this Court. 6.
Accordingly, the BLAPL stands disposed of.
