Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.786 of 2022 pending on the file of learned J.M.F.C., Betnoti, arising out of Betnoti P.S. Case No.285 of 2022, for commission of offence under Sections 420/467/468 IPC and Sections 66(B)/66(C)/66(D) of the I.T Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned 2nd Addl. Sessions Judge, Baripada by order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since 16.09.2022 and charge sheet has been filed on 12.11.2022.

It is the allegation of the prosecution that the Petitioner had obtained three loans surreptitiously in the name of the Informant. 6.
Learned counsel for the State opposes the prayer for bail. 7.
Taking into account the nature of allegation and the Petitioner is the first offender, as stated, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

While releasing on bail, learned Court in seisin shall verify the criminal antecedent of the Petitioner of similar nature. If the Petitioner has such antecedent, this order shall stand recalled. 9.
The BLAPL stands disposed of.
