This matter is taken up through hybrid mode.

This is an application for recalling the order dated 3rd November, 2022 by which the CMP was disposed of in absence of the Petitioners.

The order impugned in the CMP was passed on 5th August, 2022 rejecting an application under Order XXXIX Rule 3 C.P.C.

In view of the reason recorded by this Court in paragraph-4 of the order dated 3rd November, 2022, I am not inclined to entertain the I.A.

Accordingly, the I.A. stands dismissed.
