This matter is taken up through hybrid mode.

Learned counsel for the petitioners undertakes to remove the defect within three days.

The petitioners have filed this writ petition seeking direction to the opposite party no.1 to take immediate step for disbursement of the differential arrear keeping in view the ratio decided in the case Smt. Dipti Roy v. State of Orissa and others, 2004 (II) OLR 718. 4.

In course of hearing, learned counsel for the Petitioners states that highlighting the grievances, the Petitioners have made a representation to Opposite Party No.1 vide Annexure-5 and the same may be directed to be considered within a stipulated time, keeping in view the ratio decided in Smt. Dipti Roy (supra), to which learned Standing Counsel for School & Mass Education Department has no objection.

As agreed to by learned Counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.1 to consider the representation filed by the Petitioners vide Annexure-5 taking into consideration the judgment in the case of Dipti Roy (supra), in accordance with law within a period of three months from the date of production of certified copy this order. 6.

Issue urgent certified copy as per rules.
