1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. L.P. Dwivedy, learned counsel for the Petitioner and Mr. R.N. Mishra, learned AGA appearing for the Opp. Parties.

3. At the outset, on the oral prayer made by Mr. Dwivedy, he is permitted to implead the Authority of OSEPA as a Party to the writ Petition as O.P. No. 5.

4. Mr. Dwivedy, learned counsel for the Petitioner submitted that during pendency of the matter and pursuant to the order passed by this Court on 07.07.2021 in W.P.(C) No.13475 of 2021 and 33083 of 2020 Govt. in the Department of School & Mass Education vide its letter dtd.11.01.2022 has requested the O.P. No. 5 to take necessary steps for creation of 27 Nos. of posts of Junior Engineer (Civil) to absorb such Technical Consultants engaged under the said Authority.

5. It is submitted that in spite of such letter issued on 11.01.2022 O.P. No. 5 is not taking any further step in the matter and thereby

// 2 // the Petitioner is deprived of from getting the benefit of absorption in the post Junior Engineer (Civil).

6. In view of that this Court while disposing the writ Petition, directs O.P. No. 5 to take a decision as requested by the Govt. in the Department of School & Mass Education on 11.01.2022 within a period of two (2) months from the date of receipt of this order. Petitioner is directed to produce the copy of the letter dtd.11.01.2022 and copy of this order before O.P. No. 5 within a period of 7(seven) days from the date of receipt of the order.
