This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.511 of 2018, pending before the learned J.M.F.C., Soro, arising out of Soro P.S. Case No.256 of 2018, for commission of alleged offences under Sections 493/417/313/506/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Balasore by order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody since 21.09.2022 and it is stated that since investigation has progressed substantially, further continuance of the petitioner in custody is unwarranted.

Learned counsel for the petitioner places reliance on the compromise between the parties, which is at Annexure-3 and it is submitted that the present FIR relates to the very FIR at Annexure1, in respect of which the said compromise was effected and in fact the same is evident in the very first paragraph of the compromise. 7.

Perused the 164 Cr.P.C. statement of the informant. 8.

Considering the same and taking into account the Annexure-3, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
