This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.252 of 2022, pending before the learned J.M.F.C., G. Udaygiri, arising out of G. Udayagiri P.S. Case No.106 of 2022, for commission of alleged offences under Sections 326/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Balliguda, Kandhamal by order dated 02.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
It is submitted by the learned counsel that the petitioner is in custody since 13.07.2022 and charge-sheet has been filed on 01.11.2022, hence further continuance of the petitioner in custody is unwarranted.

On instruction, it is stated that the injured Bhismadev Mallick, who suffered grievous injury, has recovered in the meanwhile and leading a normal life.

Learned counsel for the State opposes the prayer for bail. 8.
Considering the genesis of the offence, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
