ORDER
11.11.2022 Order No.
01.
1.
This matter is taken up through hybrid mode.
2.
Heard learned counsel for the petitioners and learned counsel for the State.
3.
The petitioners are accused in G.R. Case No.191 of 2022, pending in the file of learned J.M.F.C., Saintala, arising out of Saintala P.S. Case No.196 of 2022, for alleged commission of offence under Sections 364(A) read with Section 34 of IPC. 4.
Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Titilagarh by order dated 27.09.2022 in the aforementioned case, the present BLAPL has been filed.
5.
It is submitted by the learned counsel for the petitioners that this Court by order dated 26.08.2022 directed for release of the petitioners in BLAPL No.7656 of 2022 subject to verification of criminal antecedents. Since the petitioners have antecedents, it is stated that learned Court in seisin has rejected the bail application. Hence the second journey of these petitioners to this Court.
6.
Taking into account the nature of the criminal antecedents as stated in Paragraph-6 of the petition and that the matter has been amicably settled, as noted in the earlier order granting bail, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
8.
Urgent certified copy of this order be granted as per rule. (V. NARASINGH) Judge Santoshi
