Heard learned counsel for Petitioner and learned counsel appearing for State and Mr. S.K.Patra, learned counsel appearing for the Opposite Party No.4.

The present Writ Petition has been filed with the following prayer:- "(i) Under the above circumstances, it is humbly prayed that the Original Application may be allowed and necessary direction may be made to the respondents to sanction family pension in favour of the applicants in terms of the Rule 56 of the Orissa Civil Services (Pension) Rules, 1992 as they are legal heirs of late Dhoba Pradhan after the death of his first wife, Kiya Pradhan and family pension may be released immediately in their favour within a time to be stipulated by this Hon'ble Tribunal or in the alternative, any other order / orders or direction / directions may be issued so as to give complete relief to the applicants".

Learned counsel for the Petitioner submits that through highlighting his grievances, the petitioner has filed an appeal at Annexure-7-Series to the Writ Petition, before the opposite party No.3 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.3

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.3 to take a decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

With the aforesaid observation and direction, the Writ Petition is disposed of.
